FEE SCHEDULES

There are fees associated with probate in Virginia. However, did you know that a fiduciary (an executor, administrator, or trustee) can receive compensation for serving in this role? Use the schedules below to determine compensation for fiduciaries and probate filing fees.

 

Virginia Commisioner Fee Schedule

When filing your probate reports to the Commissioner of Accounts (such as the inventory or accounting), there are filings fees due. Determine the fees here.

Virginia Fiduciary Fee Schedule

An executor, administrator, or trustee can be compensated for their duty as a fiduciary in Virginia. Utilize the fee schedule to determine the fee. Keep in mind that this fee is reduced by any payments made to professionals to help with the administrative duties and that this is considered an estate expense and is not considered as part of any distributions.

PROBATE FORMS

The Inventory and Accounting are the most frequently needed reports for probate in Virginia. If you need other forms, or instructions, see the list of Fiduciary Forms and Instructions.

 

Inventory

In Virginia, the Inventory is due to the appointed Commissioner over a probate estate within 4 months from the date of qualification.

Accounting

In Virginia, the Accounting is due to the appointed Commissioner over a probate estate within 16 months from the date of qualification.

Notice Regarding Estate

In Virginia, the Notice Regarding Estate must be sent to all heirs and beneficiaries of a probate estate within 30 days of the date of qualification. Proof of this notice must be filed with the Clerk of the Circuit Court within 4 months of the date of qualification.

Affidavit of Notice

In Virginia, the Affidavit of Notice must be filed with the Clerk of the Circuit Court within 4 months of the date of qualification, confirming that all heirs and beneficiaries of a probate estate have been notified as required by law.

If a Will cannot be located, check out the U.S. Will Registry. However, keep in mind that it is not required that a Will is registered in Virginia.
